Buying a house is a very important decision for any client as it is likely to be the biggest financial transaction of their lifetime. Nathaniel Lacy & Partners have been advising clients in relation to property purchases since their inception in 1896. In modern time this involves, among other things, advising clients at initial stages to have the property surveyed by an engineer (Caveat Emptor) to consider the structure of the house and the planning, reviewing the Contract for Sale and investigating title, raising necessary queries with the Seller’s solicitor, liaising with the Mortgage Provider to ensure that purchase monies are available on the closing date, completing the purchase, ensuring that all necessary title documents are produced and certifying title to the Mortgage Provider and ultimately registering the transfer of the property into the Purchasers’ names.
When acting for a client who is selling their property there are obviously some different considerations. These would include liaising with clients to determine where the title deeds of the house, drafting the Contract of Sale, dealing with any queries raised by the Purchaser’s solicitor, preparing the necessary title documents to be handed over to the Purchaser on completion of the sale, liaising with the mortgage provider to settle any outstanding mortgage amounts from the sale proceeds, completing the sale and transferring any balance monies remaining to our client.
Leasehold agreements are also important legal documents and all clients should seek legal advice before entering into a lease agreement. Nathaniel Lacy & Partners advise numerous clients prior to entering into such lease agreements. Such advices would include reviewing lease agreements for clients who are taking up a lease and advising them of the conditions, recommending any amendments, reviewing the title documents, preparing lease agreements, advising on the term (length) of the lease and advising on the planning permission of the property in question.
