Fatal Accident Claim Settled
A High Court action arising from the death of Derek Monaghan, a well-known Bohemian Football Club volunteer and supporter, has settled.
The matter was reported by The Irish Times under the headline “Family of well-known Bohemians fan who died while showing new car to mother-in-law settle action.”
Mr Monaghan died following an accident on August 17th, 2022, in a private car park adjacent to Grangegorman Villas, Dublin 7. The Court heard that the family had gathered near his mother-in-law’s home while Mr Monaghan was showing his new car.
The Court was told that Mr Monaghan died as he attempted to stop the car after it had taken off while his mother-in-law, Elizabeth Whelan, was seated in the driver’s seat. The car crashed into a tree and overturned. Mr Monaghan was thrown to the side of the tree and died as a result of the injuries sustained in the accident.
Ms Whelan suffered fractures to her back.
The proceedings were brought by Mr Monaghan’s widow, Elayne Monaghan, against Elizabeth Whelan and the Motor Insurers’ Bureau of Ireland. The Court heard that the MIBI was involved as Ms Whelan was not insured.
In the proceedings, Ms Monaghan and her two daughters also claimed for nervous shock, having witnessed the accident. All claims were denied.
The settlement, which is confidential, was made against the MIBI.
Noting the settlement, Judge Paul Coffey conveyed his deepest sympathy to the Monaghan family on what he described as an unusual tragedy.
